Well, folks, we’re received another letter here at LouisianaVoice Control Central and this time it’s signed.
It seems that Louisiana Alcohol and Tobacco Control (ATC) Director Troy Hebert is experiencing yet more PR problems for himself and his beleaguered office. That’s not to say, of course, that he doesn’t bring a lot of those problems on himself.
And like any good politician, he chooses to blame the messenger for his deteriorating public image—even going to the point of spending tax dollars ordering an investigation of yours truly which, I’m told, came up empty.
“You call yourselves investigators,” he told his agents a few weeks ago as he ordered them “to investigate Tom Aswell” because my credibility apparently isn’t as good as one might believe, according to one agent he fired two weeks ago. Apparently she didn’t come up with the negative background information Hebert wanted on this writer.
It’s not that Michelle Chavis didn’t try. In an interview with LouisianaVoice today, she said she checked all the newspapers for which I formerly worked as a reporter or editor—and came up dry. “You’re pretty boring,” she joked. “Actually, I found that you were very credible as a reporter and were well-respected by the older reporters and editors who remembered you.”
Well respected? Older reporters and editors? Who remembered me? If she found someone old enough to remember me, they must be in a home somewhere with a lap blanket and shoulder shawl eating bland pudding and waiting for a sponge bath from someone named Dutch.
And I haven’t spent 40 years as a reporter to be “well respected.” What kind of wimp-out is that?
Well, she did compare me favorably to the late John Copes who once had a web blog called The Deduct Box and for that comparison, I am flattered and humbled.
Be that as it may, Ms. Chavis, a veteran of 16 years in law enforcement was given her walking papers in a one-sentence note from Hebert after only four months on the job as a training specialist.
“I never saw it coming,” she said. “I’ve worked for the Shreveport Police Department and the Bossier Parish Sheriff’s Office and I’ve never been terminated from a job.
“Everything I ever suggested in the way of training was rejected out of hand by Mr. Hebert. The place was a mad house. And I can tell you that it’s true that he requires his employees to stand and chirp ‘Good morning, commissioner’ every time he enters a room.”
Chavis, after repeated unsuccessful attempts to gain an audience with Hebert to get an explanation for her dismissal, finally fired off a letter to her former boss.
With her permission, we edited some of the more inflammatory content.
Otherwise, the letter is as follows.:
Mr. Troy Hebert:
Two weeks ago, per your directive, I was issued my letter of termination by SAC Banks. After spending eight days in Baton Rouge and making regular contact with you during that time, it was a shame you could not have taken a moment to discuss the thought of dismissing me from the Agency. As a dedicated employee with exceptional PBS rankings, going above and beyond in my work and no inkling of a problem, an explanation on your decision would have been courteous.
I have few very basic expectations from this Agency; however, the spontaneous last-minute training session that you required was unorganized and shoddy. As a specialist, I should have been included on the planning and organization. A schedule and itinerary with a curriculum should have been a basic starting point. In November 2012, I submitted a very detailed list of suggested classes. Instead, I showed up and was required me to “perform on demand”—which I managed. I am not blaming Director Penouilh, as I believe he was doing the best he could with your last minute, over demanding brainstorm idea for a training session.
You wandered in and out of our training, shiftless seeking fault in others. You have a sharp dressed, useless look about you that may have worked for you when Gov. Jindal appointed you, but now that you actually have responsibility to run the ATC, you pawn it off on overworked staff, hoping their talent will cover for you flaring ineptitude. After your consistent and annoying harassment of my co-workers and me during our training session, with your childish accusations and finger pointing, I can only surmise that YOU are one of the few true wastes of our time and taxpayer dollars.
Asking me, a Training Specialist, to literally “read line for line” over 350 pages to college educated employees was not only a nuisance, insult and waste of time, but also a waste of precious oxygen. You want to criticize how ATC Agents waste taxpayer dollars and you give me a ridiculous directive to READ to eighteen Agents for TWO days? Adult learners respond best to visual, auditory, kinesthetic and environmental teaching. The number one style to AVOID is to READ to an adult.
I was hired because I know how to train employees. And you were apparently hired to supply amusement to Governor Jindal, who watches as you vainly attempt to understand the concept of running and agency while you sit back in your “private office” with you and your personal attorney Not all of us can play on our iPhones and chew bubble gum during your meetings without repercussions as does your legal counsel.
And last, but not least, during our meeting you quoted your height and weight and stated you didn’t understand why Tom Aswell’s readers refer to you as Little Troy Hebert. It was that moment that I realized just how incredibly naïve you are. Let me help you, sir. The readers are not referring to your physical description. They are referring to your character.
It was YOU who gave Agents the directive to read the articles posted on LouisianaVoice. Until then, I had never heard of the blog. It was also YOU who gave the directive to research Tom Aswell. Well sir, I have done my homework. I have found him to have to same humor and talent as John Copes of deductbox.com. If only John Copes were alive today …. I am sure he would have a field day with your shenanigans.

My gosh! If I weren’t retired, I would hire Michelle just for her courage and ethics, not to mention her observational and management skills. Shades of Joe McCarthy! Wait till CNN and MSNBC read this blog post. Right now, they both seem fascinated with Jindal. How telling this incident is of the kind of do-nothing toadies he surrounds himself with. The truth is coming out. You need to forward this blog post to every member of the LA legislature. Surely a few of them are starting to catch on. Good job, Tom! And, of course, anyone who knows you knows you’ve always been squeaky clean. Weird sense of humor but other than that … You’re the tops in my book.

Why is this buffoon still working? That’s right working, as in the LA taxpayers money paying this clown. Where is his performance rating per Civil Service guidelines? I have heard horror stories about this individual. Never heard of a dept head, employee walking, sitting, interloping with a private attorney during working hours. As a fellow reporter I find it a bit disturbing that quality stories can bring out the witch hunters to probe into your background in the hopes of what? Finding a parking ticket from 1978 that you paid three days late?
The irony is that his predecessor was fired in part—by Gov. Jindal—for allegedly running background checks on people.
What a statement. Michelle Chavis’ letter was clearly proof of an extraordinarily qualified person being disposed of by an incompetent supervisor. Certainly not the first time it’s ever happened, but particularly scary, given it occurred in a state department responsible for the overall safety of its population.
I assume Mr. Hebert was appointed by Jindal, probably with an oversized paycheck and a lot of power.
This is what insecure supervisors do when they are incompetent and feel threatened by the professionalism and skill of a subordinate. I have experienced it myself more than once. If a person does not fit, they are not wanted no matter how competent they might be.
The other trick is to kill the messenger. We see it here in this attack on the media. We see it in the schools in the attacks on the unions.
It seems that the Jindal administration is coming unglued. Quick! Get the Gum out and get it over with before he does any more damage!
It hardly seems an appropriate use of ATC resources to investigate a journalist critical of the Jindal administration. It is time for the inspector general to look into (Good Morning) Commissioner Hebert’s stewardship of this public institution. Perhaps it is time for the attorney general to do so.
Say what you want but it seems his predecessor was probably outed to make room for this jerk to have a deadhead job. That’s all that “good government” L’il booby has been preaching about. LOL

I sure wish that all of your friends can see your true colors. Said it before, having one or two employees complaining can be worked out. But when you have all of your employees complaining about the same problems, something should tell you Troy Hebert, it’s not the employees, it’s the leader they have… YOU!

I personally know Michelle and when she accepted this position she was excited and looking forward to being able to make a difference. It’s disgusting that the ineptitude of another and his ability to blame others under them stopped her from making a positive difference. Her character speaks volumes as does her pointed letter. Just another fine example of good ole Louisiana politics.
Will our legislators continue to sit on their collective thumbs and let jindal, LITTLE troy hebert (lower case used as sign of disrespect) and so many other jindal mendicants treat the state as a fiefdom? Probably so as so many of them are shortsightedly concerned only with their re-election and not with concern for the state and its citizens. And the beat of the Louisiana death knell goes on.
Great letter Mrs. Chavis and thanks for posting it for us to read Mr. Aswell. Maybe Lil troy and his hemorroid (SAC JB) can go to work for the bridge police after Lil troy gets out of jail. I know, wishful thinking.
Little troy is a legend in his own mind. If he would run for office in his home area of Jeanerette, he would not elected. He knew he had to do something else for employment so he politics for a job in which he knows nothing about. The sad thing is that the governor was stupid enough to give Little troy the job.

It seems that the IG’s office needs to be investigating Mr. Hebert much like they did Mr. Painter, his predecessor. He’s had far too many complaints (with merit) against him. To have Mr. Aswell “investigated” without merit and cause shows his blatant, continual and clear abuse of power.
Where the h#!! are the investigators?! They should be confiscating his cell phones, computers and files!!
I could certainly be wrong, been wrong many times before…. but I suspect the “Star” prosecution witness against Mr Hebert has revealed themselves & an extremely large number of potential witnesses will be forth-coming when the time comes to reconcile this episode of mismanagement & wrong-doing…
In fact, this letter will quite likely be the impetus to get the ball rolling in a manner which is irreversible, becoming the “death knell” against Mr Hebert…

I don’t like pudding.
I’ve known Michelle for several years. She is a good person and very qualified for what she had been hired to do. I feel bad for her having to go through this. Troy Hebert is a person with no soul, no code, no honor and no conscience. He destroys lives with no thought of the hurt felt by the innocents.
I was the supervisor that Hebert had interview Michelle Chavis for the job of specialists. He couldn’t stand the fact Agent McDonald was the ASAC after speaking out against his prized employee.
Michelle was very impressive and her skills were second to none. She’s a very hard worker and rarely watched the clock. She was there 12-15 hours a day. I wrote a letter thanking Michelle and another Agent for doing such great jobs.
Unfortunately, there was too much law enforcement in Michelle’s blood. Hebert doesn’t have a clue as to what law enforcement is. It’s not about intimidating your co-workers. It’s about establishing a foundation of trust with the people you work with. Trust is earned and not demanded but Hebert cannot grasp this concept.
May God look over Michelle and her family. May God watch over Lil Troy before its too late for him. Michelle, hang in there girl, we know how horrible things are up there. That’s why I resigned after 5 short months. I couldn’t continue “hunting” agents within the department due to Lil Troy’s paranoia. Keep up the good work Mr. Aswell and I look forward to testifying in upcoming trials against Lil Troy.

Are you certain that little troy isn’t asking his employees to greet him as Commissar rather than Commissioner? Quite frankly he sounds like a tyrant and I would think it both proper and advisble to investigate him for abuse of his office.

Probably not because she was still a probationary employee, meaning she could be terminated without cause.
He extended the probationary period to 2 yrs which is totally ridiculous. But he needed to have the ability to do exactly what was done to her and several other employees.

I gather that doing background investigations on journalists is a rather common practice on both state & federal levels and means you’re hitting your targets. I’d pay to see the egg on little troy’s face this morning. Tom should regularly check his car to make sure illegal “stuff” is not planted there for purposes of a “bust.” (LOL…may be watching too much TV.) Congrats Tom, you have arrived.

Now we find out he is spending taxpayers’ money investigating Tom Aswell.
It is supposed to be Hebert’s job to enforce Title 26, the alcohol and tobacco laws of this state.
Laws such as underage access to cigarettes and underage drinking enforcement.

It appears that Michelle Chavis has more courage than most of the employees that have left ATC. I, like Gene wish the best to her and her family. To say that Lilttle crash test dummy Troy lost a very talented, well spoken, and fearless employee here is to state the obvious! It reminds me of the Taliban and other extremist that are intimidated by those who are well versed and can articulate their thoughts and frustrations in the way that she has done in her letter. You can bet he and his minions have met and he will be attempting to take some action against Michelle. Just know you are right and in the end it will be those like you that will bring him down. There’s numerous agents that have filed complaints and charges against Hebert, but he is trying to do damage control by getting with his media buddies to downplay their grievances. That’s probably why we haven’t heard much about those. They were brave as well by writing letters to him that he never responded to.
I cannot wait for the day that he will be forced to resign like Painter was. It appears to be be far away since the Goveris protecting him.

Thank you for the overwhelming support. I am flattered, to say the least. There is no doubt that Mr. Hebert will come at me in some form or fashion; however, at this point he is more than welcome to a part of my pending unemployment check or government cheese. I am making the best of the situation, and hoping goverment cheese tastes good with a befitting Pinot Noir, as I have never been put in a position to try the delicacy.

From “all the news that fits”, Commish Hebert has many a trials and tribulations upon the horizon, including affairs of the heart. Stay tuned, between EEO complaints, Civil Service violations, violence in the workplace complaints, his court appearances will make media news. Unfortunately, the taxpayers of LA will pay through all these procedures, unless he is fired or put in jail. Question, if Mr Troy Hebert is remanded to jail, will he still incrue his state salary? Is there a previous ruling on this matter?
Louisiana citizens voted 11/6/12 on the”Forfeiture of Public Retirement Benefits” it passed.
5. Forfeiture of Public Retirement Benefits for Convicted Public Servants (Passed)
The amendment requires any public servant, convicted of a felony associated with his or her office, to forfeit some or all of his public retirement benefits depending on what the courts to decide. Only the publicly-funded portion of a person’s retirement benefits will be affected and they only apply to those hired, rehired or elected on or after January 1, 2013.
– with the “depending on what the courts decide” it interesting to see how harsh or not this will be, sadly very hard to depend on the courts.
kathleen, a law was passed a couple of years ago about retirement being withheld if a person is convicted of a felony while in his government job. Ironically, it was pushed through by lil troy’s district 49 rep simone champagne

His main trial will be a public hearing from a certain group that gets the media’s attention. This is going to be good. Ole Piyush better put some distance between him and Lil Troy because Lil Troy isn’t far from making national news.
Hebert you need to accept the unpleasant results of what you have done… Put away your false tears you’re not in school anymore, no one feels sorry for you…. it’s time to pay the piper……

If they do I’m pretty sure they will think twice about it. It could be a political suicide for them knowing that the numbers of votes come from families and friends that he has caused hardship for. Everyone knows he’s ran over nearly everyone at ATC a couple of times…some more than others. Agents…replaceable, Agents careers…so what, Agent’s families…doesn’t affect mine so who cares? This is Lil Troy’s mentality when he decides to make ATC the “Elite Agency.” Michelle Chavis is the prime example…along with several others. Ms Chavis was hired, had a great record, and fired after a few short months with no explanation whatsoever. SO WHAT? So it’s a family Lil Troy that depend on working in a non-hostile workforce. Maybe when the hundreds of thousands of dollars settlement bills land upon the governor’s desk for payment, will the lame stream media wake up and take notice. Since we know that this is read by “the little man”, let me ask a few rhetorical questions; does having power over the lives of people, give you a thrill up your leg? Troy Herbert is a moron not fit to work the cash register at a fast food drive thru window, and you people think he’s doing a good job? I laugh at that, because if you people only knew the truth about him and whats REALLY going on inside the walls of the ATC, Mr. Herbert would’ve been dragged outside and burned at the stake long ago…..
Please inlighten us and tell us or at least tell some one with the power and BACK BONE to do some thing about his Mis deeds!

Is anyone curious about the outcome of the Great Dane issue? The court hearing was scheduled for March 4th. Don’t tell me that this monster got away with animal cruelty.

Is the structure of the ATC legal in itself? Can one party have the power to investigate, prosecute, judge, and sentence someone who holds a liquor license?
There’s a 2012 Louisiana Supreme Court case that addresses this, I think it involved the Gaming Board. Court found a violation of Separation of Powers where the statute giving the power was so vague that it left room for complete discretion …. Really interesting line of cases.
