The way Office of Alcohol and Tobacco Control (ATC) Director Troy Hebert runs his shop, it was inevitable that one or more of his employees would end up taking legal action against him.

And when you strip grown men of their dignity by making them write lines like some school kid, that borders on the sadistic.  Such petty behavior is just asking for trouble and trouble is certain to oblige.

In fact, he already has settled a couple of discrimination claims and now three more former employees have filed suit in federal court.

Three former ATC supervisors, all black, have filed a federal lawsuit in the Baton Rouge’s Middle District claiming a multitude of actions they say Hebert took in a deliberate attempt to force the three to resign or take early retirement and in fact, conducted a purge of virtually all black employees of ATC.

Baton Rouge attorney J. Arthur Smith, III filed the lawsuit on behalf of Charles Gilmore of Baton Rouge, Daimian T. McDowell of Bossier Parish, and Larry J. Hingle of Jefferson Parish.

The lawsuit claims a pattern of racial discrimination, race-based harassment and retaliation, including the “systematic elimination of all African-American employees” of the agency.

When Hebert took over the office in November of 2010, “there were five African-American supervisors within the ATC Enforcement Division,” the suit says. Today, there are none.

One of the more egregious acts attributed to Hebert and reported earlier by LouisianaVoice was his ordering two of the plaintiffs in the latest lawsuit, Gilmore and McDowell, to go undercover to investigate a New Orleans bar where each had previously investigated in full uniform. Both men, fearing for their safety should they be recognized, requested that Hebert send other undercover agents, but he refused and told the two “to handle it,” the petition says.

On Feb. 6, 2012, Hebert relocated Gilmore from Baton Rouge to north Louisiana permanently with no prior notice and later informed agent Brette Tingle that he had reassigned Gilmore in the hope he would retire early or resign. Tingle, the petition says, advised McDowell and Gilmore on Aug. 23, 2012, that Hebert had confided in him that he intended to break up the “black trio,” a reference to McDowell, Gilmore and another agent, Bennie Walters. Walters was subsequently terminated two weeks later, on Sept. 7.

On Sept. 6, 2012, the day after Hebert demoted McDowell from Agent 3 to Agent 2 (the demotion was later rescinded), Hebert conducted an internal investigation of five agents and seized computers, iPads and cell phones and then ordered each agent to write four essays regarding ATC.

Another claim cited in the lawsuit concerns an email sent by one of the supervisor’s subordinates in which the agent failed to address Hebert as “Commissioner” or “Sir.”

Hebert, who requires that all ATC personnel rise from their seats and address him with a cheery “Good morning, Commissioner” whenever he walks into a room, responded by asking Human Resources Director Joan Ward “what type of disciplinary action” he could take “to get Hingle’s attention” to ensure his agents showed Hebert the “proper respect,” the petition says.

Hingle also claims that Hebert referred to him as “incompetent” and a “zero” in the presence of Hingle’s subordinate agents and that he confided to agent Brette Tingle that he was planning to “go after” Hingle.

On Dec. 27, 2012, Hingle said Hebert sent him a letter proposing his dismissal. He later rescinded the letter but sent a second proposal of dismissal on Jan. 22 and six days later was demoted from ATC Agent 5 to ATC Agent 3.

The lawsuit said that all three plaintiffs have received the requisite “right to sue” notice from the U.S. Department of Justice pursuant to Equal Employment Opportunity Commission (EEOC) complaints.

The three men claim that Hebert, ATC and the Louisiana Department of Revenue are liable for compensatory damages, including economic and emotional losses, loss of retirement benefits and damages to their reputations.

They are asking for a jury trial and are seeking lost wages, compensatory damages, and punitive damages.

Did the Jindal administration get the cart ahead of the horse when it announced the layoff of more than 100 state employees at a state hospital in central Louisiana?

As if Gov. Bobby Jindal did not have enough on his plate with his attempts to gain approval form the Center for Medicare & Medicaid Services (CMS) for his hospital privatization plan, now the battle over the closure of one hospital has moved into the courts.

Brad Ott of New Orleans and Ed Parker of East Feliciana Parish have named the Louisiana State Senate, the State of Louisiana and the LSU Board of Supervisors in their lawsuit filed in 19th Judicial Court in Baton Rouge.

Their petition claims that the Senate Committee on Health and Welfare violated the state’s open meetings law in approving the closure of Huey P. Long Medical Center in Pineville.

Moreover, the petition says that while more than 100 classified employees are due to receive layoff notices effective June 30, the State Civil Service Commission is not scheduled to consider the LSU layoff plan until early July.

Wait. What?

Did the LSU Board of Stuporvisors really notify 100-plus employees that they no longer had jobs—before getting formal approval of the layoff plan from Civil Service?

Surely not.

The Rules of Order of the Senate, Rule 13.73, entitled “Notice of committee meetings during session,” provides in part: “Such notices shall be posted for each meeting as soon as practicable, but not later than 1 p.m. of the day preceding the meeting day.”

Rule 13.75, entitled “Meetings prohibited without notice,” provides in part: “No meeting of a committee, regularly scheduled or otherwise, shall be held unless there is full compliance with the requirements of Louisiana Senate Rule 13.73…”

The lawsuit says the notice for the April 2, 2014, meeting of the Senate Committee on Health and Welfare was revised on April 1 at 4:04 p.m. to add the consideration of SCR 48 by Sen. Gerald Long (R-Natchitoches).

SCR 48 was the Senate Concurrent Resolution that called for the closure of Huey P. Long. The resolution passed in the House Health and Welfare Committee by a 10-8 vote after nearly three hours of debate. By contrast, the Senate Health and Welfare Committee took only 10 minutes for unanimous passage.

Both petitioners say they had planned to testify in opposition to the resolution before the committee but that they were not notified that the committee would be taking up SCR 48 on April 2 because of the last minute revision to the notice of the meeting. “Consequently, both of the petitioners were effectively prevented from observing the deliberations…and expressing their concerns,” the petition said.

Wait. What?

Would a Louisiana Senate committee really do an end run around opponents to a controversial resolution in violation of the open meetings law in order to slip the resolution through?

Surely not.

But with the administration desperate to ram its hospital privatization through despite questionable funding methods, anything is possible. Jindal, in fact, has clearly demonstrated that he will go to any length to move his agenda along.

Plaintiffs’ attorneys J. Arthur Smith and Adrienne Rachel are seeking a declaratory judgment and injunctive relief subject to the state’s open meetings law, an injunction prohibiting the state from implementing provision of SCR 48, monetary damages for violations of the state’s open meetings law, and attorney’s fees.

Smith is a relative newcomer in litigation against the state but he has sent out notice that the old ways of doing business may be changing. He has already won one battle with the Department of Education over the department’s reluctance to comply with the state’s public records laws and currently has other suits pending against the Department of Agriculture and the Office of Alcohol and Tobacco Control.

Looking back on the LSU Hospital privatization fiasco, it becomes easy to point the finger of blame in several directions.

And to a lesser extent, though by no means blameless, is the Louisiana Legislature.

The legislature has been complicit in many of Gov. Bobby Jindal’s other misadventures, most notably the unorthodox—and, it turned out, unconstitutional—method of funding the governor’s school voucher program. Lawmakers fell all over themselves in 2012 in approving that little scheme that eventually blew up in everyone’s faces when the courts rejected the manner in which Act 2 diverted money from local school districts to cover the cost of private or parochial school tuition.

In fact, Jindal’s entire education reform package, passed in such haste in 2012, quickly grew to more resemble a train wreck than legitimate reform.

But the legislature, even though it never drew a line in the dust even as it capitulated to Jindal at every turn, in the final analysis, had little say-so about nor any recourse in preventing the wholesale giveaway—disguised as privatization—of the six hospitals, a maneuver that imploded Friday with the decision by the Centers for Medicare and Medicaid Services to reject the deals that would have turned over to private operators the LSU medical centers in Shreveport, Monroe, Lafayette, Houma, Lake Charles and New Orleans.

Even as Jindal’s rubber stamp LSU Board of Stuporvisers was rubber-stamping a contract containing 50 blank pages in the infamous conflict-of-interest deal handing over University Medical Center of Shreveport and E.A. Conway Medical Center of Monroe to the Biomedical Research Foundation of Northwest Louisiana (BRF), legislators were voicing concerns over the warp speed at which the administration was moving to ram the agreement down the throats of an unsuspecting public.

In fact, a resolution passed unanimously in the Louisiana Senate at the urging of Sen. Ed Murray (D-New Orleans) called for the Joint Legislative Committee on the Budget to agree on the privatization plans before any details were to be finalized. A similar resolution was also passed in the House.

Resolutions are just that: resolutions, with no power of law. Jindal said—and an attorney general’s opinion supported the position—that legislative approval was not required in order for the LSU Board to agree to lease the hospitals. An attorney general’s opinion, like a legislative resolution, does not carry the weight of law, but does give the governor stronger footing.

Jindal, for his part, made it abundantly clear that he would move the privatization plan forward with or without legislative support. He said the legislature did not have the authority to vote down the proposals—in effect, saying his administration was ready to ram through the proposals without regard for even a pretense of democratic procedure.

Of course he did say that he would agree to take any advice from the legislative committees into consideration. “If they propose changes to the law, we’ll look at that legislation,” he said.

But we all know what happens to those who have the temerity to disagree with Jindal, don’t we? They’re summarily teagued, as in Tommy Teague, erstwhile Director of the Office of Group Benefits (OGB), who was shown the door on April 15, 2011, when he didn’t jump on board the OGB Privatization Express quickly enough. Six months before that, it was his wife Melody was fired from her state job after she testified before the Commission for Streamlining Government. More than a dozen met the same fate, including LSU President John Lombardi and at least four legislators who found themselves suddenly removed from their committee assignments for “wrong-headed” voting.

But easily the most significant, most ill-advised, most flagrant, most unwarranted demotions were those of two respected doctors who didn’t bite when Jindal dropped his privatization bait into the water—doctors any organization would be proud to have on staff (and now, two such organizations indeed have them after in sheer frustration, they finally left Louisiana).

LSU Health Care System head Dr. Fred Cerise and Interim Louisiana Public Hospital CEO Dr. Roxanne Townsend were demoted just days apart in 2012—Cerise in late August and Townsend in early September—following a July 17 meeting at which former Secretary of health and Hospitals (DHH) Alan Levine first pitched a plan to privatize the state’s system of LSU medical centers.

Levine was at the meeting on behalf of his firm, Health Management Associates (HMA).

Also present, besides Cerise, Townsend and Levine were then-LSU President William Jenkins, DHH then-Secretary Bruce Greenstein, LSU Medical Center Shreveport Director Dr. Robert Barish, HMA CFO Kerry Curry, LSU Health Science Center Shreveport Vice Chancellor Hugh Mighty and LSU Board of Supervisors members Rolfe McCollister, Bobby Yarborough, John George (remember that name) and Scott Ballard. LSU Health Science Center New Orleans Chancellor Larry Hollier and Vice Chancellor for Clinical Affairs at LSU Health Sciences Center New Orleans Frank Opelka participated by teleconference.

The meeting was held in the LSU president’s conference room.

Both Cerise and Townsend expressed reservations about Levine’s proposal but several members of the LSU Board of Supervisors who were present at the meeting “indicated they want LSU’s management to pursue this strategy,” according to a summary of the meeting prepared for Jenkins by Cerise.

Along with his two-page summation of the meeting, Cerise also submitted a third page containing a list of five concerns he had with the privatization plan pitched by Levine. It was that list of concerns which most likely got Cerise teagued as head of the LSU Health System via an email from Jenkins.

Levine, according to Cerise’s notes, recommended as an initial step that LSU sell its hospital in Shreveport (LSU Medical Center) and use the proceeds to “offset budget cuts for the rest of the LSU system.”

He suggested that the buyers would form a joint venture with LSU, invest capital into the facility and develop a strategy for LSU “to more aggressively compete in the hospital market.”

“The LSU board members present indicated they want LSU’s management to pursue this strategy,” Cerise’s notes said. “Greenstein stated that LSU should look to generate two years of funding to address the state funds shortfall in the system through the sale of Shreveport’s hospital.”

It was at that point that Cerise indicated his concern that such a strategy would take time to develop and that LSU would likely need to go through a competitive public procurement process and “likely legislative approvals.”

It was subsequently determined that legislative approval was not legally required; all that was required was for the legislature to be informed of the administration’s actions.

“There appeared to be agreement that LSU develop a plan that would not result in closure of hospitals,” Cerise’s notes said. “When the question was posed to the group, ‘Will LSU close hospitals,” George responded, ‘We hope not.’ The clear message was that the board members did not want LSU to proceed with any hospital closures at this point.”

Since that meeting, Earl K. Long Medical Center in Baton Rouge and W.O. Moss Medical Center in Lake Charles have each closed.

“I am asking that you share this memo or at least the substance of it with the full board to ensure they are informed and that their direction to us that we delay definitive budgetary action until the end of August to better assess the likelihood of a Shreveport sale with a statewide distribution of the proceeds is clear and unambiguous,” Cerise said in his memorandum to Jenkins.

At the conclusion of the meeting, Jenkins called for the creation of a task force to include then-Commissioner of Administration Paul Rainwater, Greenstein, George, Yarborough, McCollister, Ballard, Mighty, Barish, Hollier, Cerise and Townsend.

But in a matter of weeks, Cerise and Townsend were removed from their respective positions and reassigned and Opelka was promoted to Cerise’s position.

Last May, only months before he resigned to take a position in Texas, Cerise was invited by Sen. Murray to testify at a meeting of the Senate and Governmental Affairs Committee. What ensued speaks volumes about the administration’s penchant for secrecy and its intolerance for dissenting viewpoints and is illustrative of Jindal’s general arrogance and disdain for the legislative process.

The committee wanted more information about the proposed privatization of the LSU system’s hospitals and the obvious choice as the most knowledgeable witness was Dr. Fred Cerise, whose integrity is the very antithesis of Jindal’s.

So, naturally, Cerise was barred from testifying. Dissenting opinions—even intelligent, reasoned ones—are not welcomed by this governor who simply cannot bring himself to listen to the advice of others. Murray said he was told that Cerise’s request for a personal leave day to testify was denied. Murray was joined by several other senators in complaining that the denial of an information request from a lawmaker was inappropriate.

Board members, Dr. John George and Ann Duplessis, apparently with straight faces, disavowed any knowledge about Cerise’s not being able to attend the meeting and promised to look into the matter and report back to the committee.

Amazingly, lawmakers appeared to ignore that conflict of interest we alluded to earlier even as the LSU Board of Stuporvisors unanimously approved that contract. No one uttered a peep as that same Dr. John George of Shreveport, sitting as a voting member of the LSU Board, cast his vote.

The CEO of BRF, which awarded the contract for the Shreveport and Monroe medical facilities, is (trumpet fanfare) that same Dr. John George but not to worry: Jindal assured us there was no conflict of interest there.

Almost lost in all of this is the fact that more than 5,000 employees were laid off as a result of the privatizations which now have been disallowed. And for that, we look to the Louisiana Civil Service Commission as the third culprit behind Jindal and the LSU Board of Stuporvisors.

After all, you can’t put the genie back in the bottle.

The Civil Service Commission, which must approve any layoff plan, first rejected the administration’s privatization by a 4-3 vote but agreed to reconsider the proposal when the administration said it would provide additional information.

The next week, the board met again and commission member D. Scott Hughes of Shreveport apparently saw the light and inexplicably switched his vote from no to yes. More importantly, two other members, Dr. Sidney Tobias of LaPlace and commission Chairman David Duplantier of Mandeville, took the easy way out: they simply did not attend the meeting and the final vote that put 5,000 employees on the street was 3-2 in favor of Jindal.

Granted, commission members don’t receive a salary for their service but if Hughes could drive in from some 250 miles away—even with his yes vote—then surely commission Chairman Duplantier and Tobias could have, should have, found a way to drive in from about 75 and 50 miles out, respectively.

On a matter of such import, their no-show was nothing less than gutless and both should resign from the commission. They agreed to serve and their votes on this issue were of extreme importance—to the administration of course, but especially to those 5,000 employees whose livelihoods depended on the whims of seven five people they’d never met.

And then there’s that almost overlooked matter that’s lost in all the frenzy—one of utmost urgency: where will the state’s poor now seek medical care?

And the fingers of blame point directly at Jindal, the LSU Board of Stuporvisors, and the Civil Service Commission.

So now, after the approval of a contract with its 50 blank pages, after the termination of all those employees, after Jindal’s flimflamming his way around the legislative process, after the demotion and eventual loss of two valuable members of the medical profession, after DHH Kathy Kliebert’s assurances (as late as last week) that everything was just peachy, another wing of Jindal’s house of cards has come tumbling down.

If this is indicative of the way he runs a state—and all the evidence says it most assuredly is—imagine how, as president, he would fare in a faceoff with Vladimir Putin—even with the help of Jimmy Faircloth.

Here’s the political shocker of the year: Gov. Bobby Jindal says that the Republican Party would be better off selecting a governor as its 2016 presidential nominee.

Wow. Who saw that coming?

Jindal might wish to ask former Massachusetts governor Mitt Romney how that scenario worked out for him.

Wonder how Sens. Ted Cruz of Texas, Rand Paul of Kentucky and Marco Rubio of Florida feel about that little snub?

Better yet, wonder who he had in mind? Gosh, there are so many: Chris Christie of New Jersey, Wisconsin’s Scott Walker, Ohio’s John Kasich and Rick Perry of Texas whom Jindal was quick to endorse a couple of years ago before Perry’s political machine sputtered and died on some lonely back road. Then there are those former governors Jeb Bush of Florida, Mike Huckabee of neighboring Arkansas, and Sarah what’s-her-name up there in Alaska.

Oh, right. We almost forgot because well…he’s just so forgettable, but there’s also Jindal who recently placed about 12th in a 10-person straw poll at that wild-eyed, frothing-at-the-mouth Conservative Political Action Conference (CPAC).

But he’s running. You betcha (sorry, Palin, we couldn’t resist). He is so intent in his as yet unannounced candidacy that he has already drafted his own plan to replace the Affordable Care Act, aka Obamacare.

Presidential candidates are usually expected to exhibit voter empathy and to be spellbinding orators who are capable of mesmerizing of voters en masse. John Kennedy comes immediately to mind. So do Ronald Reagan and Bill Clinton. I mean, after Clinton took two steps toward that audience member in his debate against President Bush the First in 1992 and said, “I feel your pain,” Bush never had a chance. Clinton looked that voter dead in the eye and spoke one-on-one as Bush was checking his watch.

Jindal has all the empathy of Don Rickles, but without the charisma.

As for oratory skills, to borrow a line from a recent Dilbert comic strip, he should be called the plant killer: when he speaks, every plant in the room dies from sheer boredom.

So much for his strong points: let’s discuss his shortcomings.

Jindal believes—is convinced—he is presidential timber. The truth is he has been a dismal failure at running a state for the past six years and he’s already written off the final two as he ramps up his campaign for POTUS.

Yes, we’ve been beset by hurricanes Katrina, Rita, Ike and Gustav. Yes, we had the BP spill. All of those provided Jindal valuable face time on national TV and still he trails the pack and when you’re not the lead dog in the race, the view never changes.

Because of those catastrophes, the state has been the recipient of billions of federal dollars for recovery. Nine years later, Jindal cronies still hold multi-million contracts (funded by FEMA) to oversee “recovery” that is painfully slow. The state received hundreds of millions of dollars to rebuild schools in New Orleans. Construction on many of those schools has yet to commence. The money is there but there are no schools. (Correction: Largely white Catholic schools have received state funding and those facilities are up and running.)

Jindal tried to restructure the state’s retirement system—and failed. Yes, the retirement systems have huge unfunded liabilities but Jindal’s solution was to pull the rug from under hard-working civil servants (who by and large, do make less than their counterparts in the private sector: you can look it up, in the words of Casey Stengel). As an example, one person whom we know was planning to retire after 30 years. At her present salary, if she never gets another raise over the final eight years she plans to work, her retirement would be $39,000 per year.

Under Jindal’s proposed plan, if she retired after 30 years, her retirement would have been $6,000—a $33,000-a-year hit. And state employees do not receive social security.

Never mind that state employees have what in essence is a contract: he was going to ram it down their throats anyway—until the courts told him he was going to do no such thing.

He has gutted higher education and his support of the repeal of the Stelly Plan immediately after taking office has cost the state a minimum of $300 million a year—$1.8 billion during his first six years in office.

He even vetoed a renewal of a 5-cent per pack cigarette tax because he opposed any new taxes (try following that logic). The legislature, after failing to override his veto, was forced to pass a bill calling for a constitutional amendment to make the tax permanent. Voters easily approved the amendment.

Then there was the matter of the Minimum Foundation Program, the funding formula for public schools. Funds were going to be taken from the MFP to fund school vouchers until the courts said uh-uh, you ain’t doing that either.

Jindal’s puppets, the LSU Board of Stuporvisors, fired the school’s president and two outstanding and widely admired doctors—all because they didn’t jump on board Jindal’s and the board’s LSU hospital privatization plan. Then the stuporvisors voted to turn two LSU medical facilities in Shreveport and Monroe over to a foundation run by a member of the stuporvisors—and the member cast a vote on the decision. No conflict of interest there.

Six months after the transition, the Center for Medicare Medicaid Services (CMS) has yet to approve the transition and if it ultimately does not approve it, there will be gnashing of hands and wringing of teeth in Baton Rouge (That’s right: the administration won’t be able to do that correctly, either) because of the millions of dollars in federal Medicaid funding that the state will not get or will have to repay. Jindal will, of course, label such decision as “wrong-headed,” which is an intellectual term he learned as a Rhodes Scholar.

And from what we hear, his little experiment at privatizing Southeast Louisiana Hospital (SELH) in Mandeville by bringing in Magellan to run the facility isn’t fairing too well, either.

By the way, has anyone seen Jindal at even one of those north Louisiana Protestant churches since his re-election? Didn’t think so.

For some reason, the word repulsive keeps coming to mind as this is being written.

The LSU Board of Stuporvisors, by the way, even attempted to prevent a release of a list of potential candidates for the LSU presidency. One might expect that member Rolf McCollister, a publisher (Baton Rouge Business Report), would stand up for freedom of the press, for freedom of information and for transparency. One would be wrong. He joined the rest of the board to unanimously try to block release. Again, led as usual by legal counsel Jimmy Faircloth who has been paid more than $1 million to defend these dogs (dogs being the name given to terrible, indefensible legal cases), Jindal was shot down in flames by the courts and the Board of Stuporvisors is currently on the hook for some $50,000 in legally mandated penalties for failing to comply with the state’s public records laws.

It would be bad enough if the administration’s legal woes were limited to the cases already mentioned. But there is another that while less costly, is far more embarrassing to Jindal if indeed, he is even capable of embarrassment at this point (which he probably is not because it’s so hard to be humble when you’re right all the time).

In a story we broke more than a year ago, former state Alcohol and Tobacco Control commissioner Murphy Painter refused to knuckle under to Tom Benson and Jindal when Benson’s application for a liquor license for Champions Square was incomplete both times it was submitted. Budweiser even offered an enticement for gaining approval of a large tent and signage it wanted to erect in Champions Square for Saints tailgate parties: a $300,000 “contribution” to the Louisiana Stadium and Exposition District (Superdome), whose board is heavily stacked with Jindal campaign contributors.

Jindal fired Painter. Because firing him for doing his job might be bad press, more solid grounds were sought and Painter was subsequently arrested for sexual harassment of a female employee and of using a state computer database to look up personal information on people not tied to any criminal investigation (something his successor Troy Hebert ordered done on LouisianaVoice Publisher Tom Aswell).

The female employee recanted but Painter nevertheless was put on trial and once more the Jindalites were embarrassed when Painter was acquitted on all 29 counts. Unanimously.

But wait. When a public official is tried—and acquitted—for offenses allegedly committed during the scope of his duties (the Latin phrase is “in copum official actuum”) then Louisiana law permits that official to be reimbursed for legal expenses.

In this case, Jindal’s attempt to throw a state official under the bus for the benefit of a major campaign donor (Benson and various family members), will wind up costing the state $474,000 for Painter’s legal fees and expenses, plus any outstanding bills for which he has yet to be invoiced.

So, after all is said and done, Jindal still believes he is qualified for the highest office in the land. He is convinced he should be elevated to the most powerful position in the world. If he has his way, it won’t be an inauguration; it’ll be a coronation.

So intoxicated by the very thought of occupying the White House is he that he has presumed to author a 26-page white paper that not only critiques Obamacare but apparently details his plan to replace the Affordable Care Act. Could that qualify as another exorcism on his part?

His epiphany, however, appears to be more akin to the Goldfinch that regurgitates food for its young nestlings than anything really new; it’s just a rehash of old ideas, it turns out.

During his entire administration—and even when he served as Gov. Mike Foster’s Secretary of the Department of Health and Hospitals—he devoted every waking moment to cutting Medicaid and depriving Louisiana’s poor citizens of health care. Even as head of DHH, according to campaign ads aired on the eve of the 2003 gubernatorial election, he made a decision which proved fatal to a Medicaid patient. That one campaign ad was aired so close to the election date that he was unable to respond and it no doubt contributed to his losing the election to then-Lt. Gov. Kathleen Blanco but he won four years later.

Nevertheless, his sudden interest in national health care prompts the obvious question: where the hell has he been for six years?

Not that we would for a moment believe that his newfound concern for healthcare is for political expedience but he apparently isn’t stopping there as he sets out to save the nation.

“This (health care plan) is the first in a series of policies I will offer through America Next (his newly established web page he expects to catapult him into the White House) over the course of this year,” he said.

We can hardly wait.

Something’s not quite right over at the Louisiana Workforce Commission (LWC).

Conflicting dates of employment of an unclassified employee, the awarding of a contract to a vendor whose bid was nearly twice that of two competitors, and appearances on behalf of a state contractor at a Florida convention by a state legislator have flown under the radar until now.

Wes Hataway is Director of the Office of Workers Compensation Administration but the question is just when did he join LWC?

Department of Civil Service records and minutes of the Worker’s Compensation Advisory Council simply do not match up.

Civil Service records indicate that Hataway was hired as an unclassified Assistant Attorney General on Jan. 25, 2010 at $93,600 per year and 13 months later, on Feb. 21, 2011, moved over to LWC as an unclassified Assistant Secretary to then advisory council Chairman Chris Broadwater at an annual salary of $105,000.

Here is what we received from the Department of Civil Service:

“See information below on Wes Hataway. Let me know if you have any questions or need more information.”

And indeed, there is a paper trail that appears to support that time frame. A two-page score sheet that evaluated proposals for a fraud detection contract with LWC dated June 22, 2010, includes the signature of Hataway and identifies him as one of the four-member team that evaluated and made recommendations for the contract. It also identifies him as representing the Attorney General’s Office—six months after he was ostensibly named as legal council for the Office of Workers’ Compensation (OWC).

But another document dated Jan. 28, 2010, casts doubts as to Hataway’s status at LWC.

Minutes of the Jan. 28, 2010, meeting of the Workers’ Compensation Advisory Council contain an entry on the fourth and final page which says, “Director Broadwater introduces newly hired AG attorney, Wes Hataway. Wes will serve as General Counsel, and also work on the prosecution of fraud cases.”

Hataway has since replaced Broadwater as Director of OWC but he regularly consults with Broadwater on pending matters coming before him, according to court documents, according to legal documents.

Broadwater, a Republican from Hammond, was elected to the Louisiana House of Representatives in 2011 but continues to represent workers’ comp insurance companies before the Office of Workers’ Compensation, the agency he once ran.

Broadwater also appeared in a four-minute video at an SAS Institute conference in Orlando, Florida. In that video, he praised the work of the company, which won that 2010 contract with a high bid of nearly $4.3 million.  http://www.allanalytics.com/video.asp?section_id=3427&doc_id=269491#msgs

The three-year contract, which was officially approved on Oct. 7, 2010 retroactive to Aug. 31, 2010, ended last Aug. 30.

The SAS bid was nearly double the bids of IBM and Ultix, each of whom had bids of $2.2 million.

Broadwater, Vice Chairman of the House Labor and Industrial Relations Committee, said in a letter to LouisianaVoice, “My service as vice chair of the Labor & Industrial Relations Committee in no manner alters my duties or the constraints placed upon me under the Code of Governmental Ethics.”

And while claiming that he is prohibited from receiving compensation “from a source other than the legislature for performing my public duties,” he admitted in a legal deposition that he represented insurance clients before OWC and he even admitted that he discussed with Hataway the pending appointment of his former law partner and that he has discussed with Hataway on several occasions matters pending before OWC.

Broadwater also related that Hataway had sought his advice on whether or not he (Hataway) had the authority as director to issue a stay of pending cases without involving the judges to whom the cases were assigned. Broad said in his deposition that he was of the opinion that Hataway did have such power.

Broadwater and Hataway are friends of long standing but that does little to explain why Broadwater would introduce him to council members as a new hire a full year before Civil Service Records and the RFP evaluation and recommendation form reflect any change from his employment status at the Attorney General’s office.

Calling the conflicting dates a clerical error doesn’t fly but then again, it could be just another aspect of the current administration that defies explanation.
